Terms of service

These terms are the agreement between you and Loud Cat Studios LLC, a Colorado company that runs Farwatch (“we”). They cover the Farwatch app and farwatch.app. By creating an account, or by using Farwatch without one, you agree to them. They're written in plain language on purpose; if something is unclear, ask us at privacy@farwatch.app.

What Farwatch is, and what it isn't

Farwatch helps you send your trip plan to the people you're counting on, and shows you whether each of them has read it. It is a convenience on top of the safety practice you already follow, not a replacement for it.

Farwatch is not an emergency service. It doesn't track your location or monitor your trip. It doesn't alert anyone when a trip runs late: “overdue” is a label someone sees only if they open the plan. It never contacts the emergency contact on a plan, and it never contacts search and rescue. Every email Farwatch sends is one a person caused, such as sending the plan or marking the trip back safe; nothing is sent on a timer.

If you or someone else is in danger, contact emergency services directly. In the US, call 911.

Your account

  • You must be at least 13 to use Farwatch.
  • Give us accurate details, and keep your password to yourself. You're responsible for what happens under your account.
  • You can delete your account at any time in the app. What that does to your trips, and to plans you've already sent, is described in our privacy policy.

Information about other people

A plan holds other people's details: the watchers you send it to, the emergency contact you name, and anyone listed in a file you attach. Only add details you have the right to share, and let those people know you've added them. Farwatch emails a watcher only because you added them, so they will hear from us in your name.

If someone sent you a plan

You don't need an account to read a plan someone sent you. Confirming records that you read it, and nothing more. It doesn't make you responsible to Farwatch for the traveler's safety, and Farwatch doesn't treat it as a promise to act. Anything you and the traveler have agreed between yourselves is between you. The link you were sent is the only thing that opens the plan, so don't share it with anyone who shouldn't see the trip.

Using Farwatch fairly

Don't use Farwatch to:

  • break the law, or help anyone else break it;
  • harass anyone, or send plans to people as spam rather than to people you're counting on;
  • upload anything harmful, such as malware, or anything you don't have the right to share;
  • get into plans or accounts that aren't yours, or interfere with how Farwatch runs.

We may suspend or close an account that does.

Your plans are yours

You own what you put into Farwatch. You give us permission to store it, and to show it to the people you send it to, only as far as running Farwatch needs.

Farwatch Plus

Farwatch Plus is an optional subscription that adds features. Everything you need to plan a trip, send it, see who has read it, and mark yourself back safe stays free.

  • You buy Plus through the App Store or Google Play, which take the payment and bill you under their own terms. The price, and any free trial, are shown there before you buy.
  • It renews automatically until you cancel it, which you do in your App Store or Google Play subscription settings. Cancelling stops the next renewal, and Plus lasts until the end of the period you've paid for.
  • Refunds are handled by Apple or Google under their own policies.
  • Plus keeps the attachments on trips you created for as long as you subscribe. When Plus ends, they are kept for 30 more days. After that, the rule for everyone without Plus applies: a trip's attachments are deleted 90 days after the trip ends, so any already past that point are deleted then. A deleted file can't be brought back, including by subscribing again. Our privacy policy has the details.
  • Deleting your Farwatch account doesn't cancel the subscription. Cancel it in the store as well.
  • We may change what Plus includes or what it costs. The store tells you about a price change before it applies to you.

Paying doesn't change what Farwatch is. Plus doesn't make Farwatch an emergency service or make a trip any safer, and its features come with the same lack of guarantees, and the same limits on our liability, as the rest of Farwatch.

Availability

Farwatch is free to use, with paid features in Farwatch Plus, and we run all of it on a best-effort basis. It may be unavailable at times, and we may change or remove features. Email can be delayed, filtered as spam, or never arrive, so a watcher may not receive your plan even when Farwatch shows it as sent. Don't make Farwatch the only way someone knows where you've gone.

No warranties

Farwatch is provided “as is” and “as available”. As far as the law allows, we make no promises about it, express or implied, including that it will be available, accurate, or fit for any particular purpose.

Limits on our liability

Time outdoors carries real risk, and the decisions you make on a trip are yours. As far as the law allows, we aren't liable for injury, death, loss or damage connected with a trip, or with a plan that wasn't delivered, read or acted on, or for any indirect or consequential loss. As far as the law allows, our total liability to you for anything to do with Farwatch is limited to US$50.

Some places don't allow some of these limits. Where that's the case, they apply only as far as the law there permits.

Changes to these terms

When these terms change, we'll update this page and the date at the top. If a change is significant, we'll also tell account holders before it takes effect. Using Farwatch after a change means you accept the new terms.

Governing law

These terms are governed by the laws of Colorado, and any dispute about them will be handled in the state or federal courts located in Colorado.
